- Our equipment is sold for general wellness and educational use. It is not a medical device, and we do not give medical advice.
- The FDA has not evaluated or approved our products to diagnose, treat, cure, or prevent any disease.
- Ozone gas is hazardous if misused. You are responsible for ventilation, safe operation, and using the correct oxygen source.
- Returns: 14 days, unused and unopened only. Anything gas, liquid, or oil has touched cannot be returned, for hygiene reasons.
- If something goes wrong, our financial responsibility is limited to what you paid for the product, except where the law does not permit that limit.
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding contract between you and AeroFlow03 ("AeroFlow03," "we," "us," or "our").
They apply when you browse this website, create an account, or place an order. By doing any of those things, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.
If you do not agree, do not use our website and do not purchase our products.
2. Who We Are
AeroFlow03 is a direct-to-consumer reseller. We source, brand, package, and sell equipment that is designed and manufactured by third-party original equipment manufacturers ("OEMs").
This means:
- We do not manufacture the hardware. We select it, brand it, and sell it.
- Manufacturing defects, engineering specifications, and build quality originate with the OEM.
- Where the OEM provides a warranty, we pass it through to you as described in Section 12.
- Our branding on a product does not make us its manufacturer or designer for the purposes of any warranty or product liability claim, except as required by law.
3. Eligibility
To buy from us, you must:
- Be at least 18 years old and legally able to enter a binding contract;
- Provide accurate, complete billing and shipping information;
- Confirm that owning and operating ozone-generating equipment is legal where you live.
Ozone-generating devices are regulated differently across states and countries. Some jurisdictions,California in particular, which regulates ozone-emitting air-cleaning devices, impose restrictions on the sale, certification, or use of this equipment. You are solely responsible for confirming that your purchase and intended use comply with all laws applicable to you. We may cancel and refund any order we believe cannot be lawfully fulfilled to your location.
We do not knowingly sell to minors. If we learn a purchaser is under 18, we will cancel the order.
4. Accounts
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms, submit fraudulent orders, or abuse our return policy.
5. Not Medical Advice
Read this section carefully. It defines what our products are and are not.
5.1 Educational and General Wellness Purposes Only
All content published by AeroFlow03, including product descriptions, specifications, instructional videos, guides, articles, emails, social media posts, and customer support conversations, is provided strictly for educational and general wellness purposes.
None of it is medical advice. None of it is a diagnosis, a treatment protocol, a prescription, or a clinical recommendation.
5.2 No Practitioner Relationship
We are an equipment retailer. We are not physicians, dentists, naturopaths, nurses, or licensed healthcare providers of any kind, and we do not act as any.
Nothing you read on our website or receive from our team creates a doctor–patient, practitioner–client, or professional relationship of any kind. Our support staff can help you with hardware questions, assembly, fittings, output settings, maintenance. They cannot and will not advise you on dosage, protocols, treatment of any condition, or whether a given application is appropriate for your body.
5.3 Consult a Qualified Professional
Always consult a licensed physician or qualified healthcare provider before beginning any wellness practice involving ozone, particularly if you:
- Have any medical condition, including respiratory, cardiovascular, or immune conditions;
- Have a G6PD deficiency, hyperthyroidism, or a bleeding or clotting disorder;
- Are pregnant, may become pregnant, or are breastfeeding;
- Are taking any medication or undergoing any medical treatment;
- Are considering any internal, mucosal, dental, or topical application.
Never disregard, delay, or discontinue professional medical advice because of something you read on our website or received from us.
If you are experiencing a medical emergency, stop and call emergency services immediately.
5.4 Testimonials and Customer Reviews
Any testimonial, review, case study, or customer story appearing on our website describes one individual's personal experience. Such accounts are not scientific evidence, are not typical, are not verified by us, and are not a promise or prediction of any result you will experience. We publish them as customer opinion, not as product claims, and we expressly disclaim them as such.
6. FDA Disclaimer
This section is a material condition of your purchase.
6.1 No FDA Evaluation or Approval
Statements made by AeroFlow03 regarding our products have not been evaluated by the United States Food and Drug Administration ("FDA").
Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
6.2 Our Products Are Not FDA-Approved or FDA-Cleared Medical Devices
The hardware we sell, including ozone generators, kits, accessories, tubing, diffusers, and regulators, has not been approved, cleared, certified, registered, or authorized by the FDA as a medical device for any therapeutic or diagnostic purpose.
"Medical-grade," as used anywhere by AeroFlow03, is a description of materials, construction quality, and manufacturing tolerances only. It refers to characteristics such as quartz cells, 316 stainless steel fittings, and ozone-resistant components. It does not mean, and must not be interpreted to mean, that a product is an FDA-regulated medical device, that it is approved or cleared by any regulatory body, or that it is authorized for clinical or human medical use.
6.3 Acknowledgment of Regulatory Position
You acknowledge that you are aware, and have been advised by us, that:
- The FDA has not approved ozone for medical use;
- The FDA has taken the formal position that ozone is a toxic gas with no known useful application in specific, adjunctive, or preventive medical therapy (see 21 C.F.R. § 801.415);
- We make no claim to the contrary, and any suggestion otherwise from any source is not endorsed, adopted, or authorized by us.
You are purchasing general-purpose equipment. What you choose to do with it is entirely your own decision and your own responsibility.
7. Assumption of Risk and Safe Operation
Ozone is a hazardous gas. This section transfers operational responsibility to you. Do not purchase if you are unwilling to accept it.
7.1 You Accept the Risks
By purchasing, you knowingly, voluntarily, and expressly assume all risks associated with acquiring, possessing, operating, maintaining, and using ozone-generating equipment and any related gases, oils, liquids, or accessories, including risks of property damage, fire, chemical exposure, respiratory injury, serious bodily injury, and death.
You accept these risks whether or not they arise from a hazard you anticipated, and whether or not any warning specifically described them.
7.2 Ventilation Is Your Responsibility
Ozone is a respiratory irritant and is toxic to inhale. Inhaling ozone can cause coughing, chest pain, shortness of breath, throat irritation, lung inflammation, and permanent respiratory damage.
You are solely responsible for:
- Never intentionally inhaling ozone gas, under any circumstances;
- Operating equipment only in well-ventilated areas;
- Properly venting, capturing, or destroying all excess and off-gassed ozone;
- Using an appropriate ozone destruct unit or venting arrangement where required;
- Keeping people and animals out of any area where ozone may accumulate;
- Monitoring ambient ozone levels where appropriate to your setup;
- Immediately ceasing operation and ventilating the area if you smell ozone or experience any respiratory symptom.
7.3 Oxygen Sourcing and Gas Handling Is Your Responsibility
Our generators require an external oxygen source that we do not supply. You are solely responsible for sourcing, handling, storing, and connecting that supply safely, including:
- Obtaining oxygen lawfully and from a legitimate supplier, and obtaining any prescription or authorization your jurisdiction requires;
- Using only an oxygen source and purity appropriate to the specific unit you purchased;
- Never feeding a unit designed for pure oxygen with ambient air, or vice versa, where the manufacturer prohibits it;
- Using a correct, undamaged, oxygen-rated regulator at the correct flow rate and pressure;
- Safe handling, securing, transport, and storage of high-pressure gas cylinders, which can become lethal projectiles if damaged or dropped;
- Keeping oxygen, oxygen fittings, and equipment completely free of oil, grease, and hydrocarbons, which can ignite explosively in an oxygen-enriched atmosphere;
- Keeping all ignition sources, open flames, and smoking materials away from the operating area,oxygen dramatically accelerates combustion.
7.4 Materials and Safe Operation Are Your Responsibility
You are further solely responsible for:
- Reading and following all manufacturer instructions and safety documentation before first use;
- Using only ozone-resistant materials, such as silicone, PTFE, glass, and 316 stainless steel, in any ozone gas path. Ozone rapidly degrades rubber, vinyl, and many plastics, which can cause leaks, contamination, and failure;
- Replacing tubing, diffusers, and consumables at appropriate intervals;
- Proper electrical safety, correct voltage, and protection from moisture;
- Keeping equipment secured away from children, vulnerable persons, and animals;
- Ensuring anyone else who operates your equipment is fully informed of these risks;
- Making your own independent judgment about the suitability, safety, and legality of any application you pursue.
7.5 No Human or Animal Medical Use
Our equipment is not sold for use in or on the human or animal body. Any decision to apply ozone, ozonated water, ozonated oil, or ozonated liquid in, on, or near a body, including drinking, rinsing, insufflation, topical application, or any dental, mucosal, or internal use, is made entirely at your own risk and on your own initiative, and should only be undertaken under the supervision of a qualified licensed healthcare professional.
We do not instruct, encourage, endorse, prescribe, or recommend any such use.
7.6 Acknowledgment
You acknowledge that you have read this Section 7 in full, that you understand the hazards described, and that you accept sole responsibility for safe operation. This acknowledgment survives delivery of your order and continues for as long as you possess the equipment.
8. Products, Descriptions, and Pricing
We work to describe our products accurately, but we do not warrant that descriptions, specifications, images, colors, or other content are complete, current, or error-free. Product images are representative; actual items may differ slightly, and OEM components may be revised without notice.
All prices are in U.S. dollars and exclude taxes, duties, and shipping unless stated otherwise. Prices are subject to change without notice.
We reserve the right to correct pricing or description errors even after an order is submitted. If a product's correct price is higher than the price shown, we will contact you to confirm or cancel before shipping, or cancel and refund you in full.
We may limit quantities, restrict sales, or discontinue any product at any time.
9. Orders and Payment
Your order is an offer to purchase. No contract of sale exists until we accept your order by shipping it. An order confirmation email acknowledges receipt; it is not acceptance.
We may refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, stock unavailability, resale activity, or where we believe the sale would be unlawful in your jurisdiction. If we cancel a paid order, we refund it in full.
By providing payment details you confirm you are authorized to use that payment method. Payment is processed by third-party providers (such as Stripe and PayPal) under their own terms; we do not store full payment card numbers.
Certain heavy or freight-shipped items may be quoted separately for shipping and invoiced after your order is placed.
10. Shipping, Delivery, and Risk of Loss
Delivery estimates are estimates only, not guarantees. We are not liable for carrier delays, weather, customs holds, or other events beyond our control.
Title and risk of loss pass to you when the carrier takes possession of your shipment.
If your order arrives visibly damaged, you must note the damage with the carrier at delivery and notify us within five (5) days of delivery, with photographs of the packaging and contents. Claims outside this window may be denied by the carrier and cannot be honored by us.
For international orders, you are the importer of record and are responsible for all duties, taxes, customs fees, and compliance with your country's import laws. Refused or seized international shipments are not refundable.
11. Returns, Hygiene and Safety Policy
This policy is stricter than general retail because of what our products do. Please read it before ordering.
11.1 The 14-Day Window
You may request a return within fourteen (14) calendar days of delivery, and only if the item is:
- 100% unused;
- Unopened, with all factory seals and shrink-wrap fully intact;
- In its original packaging, undamaged, with all manuals, inserts, and accessories included.
Requests made after 14 days cannot be accepted for any reason.
11.2 Strictly Non-Returnable Items
Because this equipment carries gases, liquids, and oils that contact the human body, used items cannot be resold, sanitized to an acceptable standard, or accepted back under any circumstances.
The following are strictly non-returnable and non-refundable, with no exceptions:
- Any item that has been powered on, run, or operated in any way;
- Any item through which ozone, oxygen, or any other gas has passed;
- Any item that has contacted water, oil, saline, or any other liquid;
- Any item removed from sealed or sterile packaging, whether used or not;
- Tubing, diffusers, diffuser stones, cannulas, catheters, syringes, cups, bags, funnels, and all single-use or personal-contact accessories, once opened;
- Ozonated oils, carrier oils, and consumables of any kind;
- Items returned incomplete, damaged, or without original packaging;
- Custom-configured, made-to-order, or special-order equipment;
- Clearance, final-sale, and open-box items;
- Gift cards.
Opening the sealed packaging of an accessory that contacts gas, liquid, or the body waives your right to return it. If you are unsure whether an item suits your setup, contact us before opening it.
11.3 How to Return an Item
- Email us within 14 days of delivery with your order number and reason.
- We will issue a Return Merchandise Authorization (RMA) number if the item qualifies.
- Ship the item back within 7 days of receiving the RMA, with the RMA number clearly marked.
Returns sent without an RMA will be refused and not refunded.
- Return shipping is at your expense, unless the return results from our error.
- Original shipping charges are non-refundable.
- We strongly recommend insured, tracked shipping. You bear the risk of loss or damage in transit back to us.
- Returns are inspected on arrival. If inspection shows the item was used, opened, or exposed to gas, liquid, or oil, the return is rejected, no refund is issued, and the item will be returned to you at your cost or disposed of after 30 days.
- Approved refunds are issued to the original payment method within 10 business days of inspection.
- We may apply a restocking fee of up to fifteen percent (15%) on items returned with damaged or missing packaging.
11.4 Defective and Warranty Items Are Separate
This return policy does not cover defective products. If a product arrives non-functional or fails in normal use, do not return it under this section, see Section 12, which governs warranty claims and is not limited to 14 days.
11.5 Refused and Undeliverable Shipments
Shipments refused at delivery or returned as undeliverable due to an incorrect address you supplied will be refunded less original shipping, return freight, and any applicable restocking fee. Non-returnable items under §11.2 are not refunded if refused.
12. Warranty and Disclaimer of Warranties
12.1 Manufacturer Warranty Pass-Through
Where our OEM provides a warranty on a product, including any lifetime or transferable warranty on ozone-generating chambers or cells,we pass that warranty through to you on its original terms. The written warranty documentation supplied with your product controls its scope, duration, exclusions, and claim process.
To make a warranty claim, contact us with your order number and a description of the fault. We will coordinate with the OEM. Warranty remedies are limited to repair, replacement, or refund, at the warranty provider's discretion.
Warranty coverage does not apply to damage caused by misuse, accident, neglect, unauthorized modification or repair, use of non-ozone-resistant materials, incorrect oxygen supply, improper voltage, moisture, or failure to follow manufacturer instructions.
12.2 Disclaimer of All Other Warranties
EXCEPT FOR THE OEM WARRANTY DESCRIBED IN SECTION 12.1 AND ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We specifically do not warrant that any product will produce any particular health, wellness, therapeutic, or physiological outcome.
Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you. In those states, any implied warranty is limited to the shortest period permitted by law.
13. Limitation of Liability
This section limits what you can recover from us. Read it carefully.
13.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF AEROFLOW03, ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS, ARISING OUT OF OR RELATING TO THESE TERMS, OUR WEBSITE, OR ANY PRODUCT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR ANY OTHER THEORY, SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
This cap applies in the aggregate, not per claim, and applies even if a limited remedy is found to have failed its essential purpose.
13.2 No Indirect or Consequential Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, or for lost profits, lost revenue, lost data, business interruption, loss of goodwill, medical or healthcare expenses, or the cost of substitute products,even if we have been advised of the possibility of such damages.
13.3 Specific Exclusions
Without limiting the above, we are not liable for any loss, injury, illness, or damage arising from:
- Your use, misuse, or application of any product in, on, or near the human or animal body;
- Inhalation of or exposure to ozone gas;
- Failure to ventilate properly or to use appropriate ozone destruction;
- Your sourcing, handling, storage, or connection of oxygen or any other gas;
- Fire, combustion, or explosion involving oxygen-enriched atmospheres;
- Use of non-ozone-resistant materials, incorrect fittings, or degraded consumables;
- Any decision you make regarding your health, or any delay in seeking professional medical care;
- Reliance on any educational content, article, testimonial, or general information we publish;
- Third-party content, products, or services.
13.4 What This Section Does Not Limit
Nothing in these Terms excludes or limits our liability where the law does not permit exclusion or limitation. This includes, depending on your jurisdiction, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence, for willful misconduct, and for any other liability that cannot lawfully be limited.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations above may not fully apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
13.5 Basis of the Bargain
You acknowledge that the prices of our products reflect this allocation of risk, that these limitations are a material and essential basis of our agreement, and that we would not sell to you on these terms without them.
14. Indemnification
You agree to defend, indemnify, and hold harmless AeroFlow03, its affiliates, and their officers, directors, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or related to:
- Your use, misuse, modification, or resale of any product;
- Your breach of these Terms, particularly Section 7 (Assumption of Risk and Safe Operation);
- Any injury or damage to you or to any third party, including anyone you permit to use your equipment;
- Your violation of any law or of any third party's rights;
- Any health, wellness, or treatment decision you or anyone else makes involving our products.
15. Acceptable Use and Resale Restrictions
You may not:
- Purchase for commercial resale without our prior written authorization;
- Represent yourself as an authorized AeroFlow03 dealer, distributor, or affiliate without a written agreement;
- Market, advertise, or resell our products with medical, therapeutic, disease-treatment, or curative claims, or in any way that would place us in violation of FDA, FTC, or other regulations;
- Remove, alter, or obscure any branding, serial number, warning label, or safety documentation;
- Use our website unlawfully, attempt to breach its security, scrape it, or interfere with its operation;
- Reverse-engineer our products for competing manufacture.
Violation of this section is grounds for immediate order cancellation, account termination, and voiding of all warranty coverage.
16. Intellectual Property
The AeroFlow03 name, logo, branding, website design, text, graphics, photography, and video are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view this content for personal, non-commercial purposes only. All other rights are reserved. Third-party trademarks, including OEM marks, remain the property of their respective owners.
17. Reviews and Submissions
If you submit a review, photo, testimonial, or other content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, and display it in connection with our business.
You represent that your submission is truthful and your own. You may not submit content making medical, therapeutic, or disease-treatment claims. We may edit, decline to publish, or remove any submission at our sole discretion, and routinely remove content that could be construed as a health claim.
18. Privacy
Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
19. Third-Party Links and Content
Our website may link to third-party sites, research, protocols, or resources. These are provided for reference only. We do not control, endorse, verify, or accept responsibility for third-party content, including any medical or therapeutic claim made by a third party, and your dealings with them are solely between you and them.
20. Dispute Resolution
20.1 Talk to Us First
Before filing any formal claim, you agree to contact us and give us thirty (30) days to resolve the matter informally. Most disputes are resolved at this stage.
20.2 Binding Arbitration and Class Action Waiver
Please read this subsection carefully. It affects your legal rights.
If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or any product shall be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in an individual capacity.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief for intellectual property infringement in court.
Your right to opt out. You may reject this arbitration agreement by emailing us with your name, order number, and a clear statement that you opt out of arbitration, within 30 days of your first purchase. Opting out does not affect any other part of these Terms.
20.3 Governing Law and Venue
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Where arbitration does not apply, the exclusive venue is the state and federal courts located in Tennessee, and you consent to their personal jurisdiction.
20.4 Time Limit
Any claim must be brought within one (1) year after it arises, or it is permanently barred, except where a longer period is required by law.
21. Changes to These Terms
We may update these Terms at any time. The revised version takes effect when posted, with an updated "Last updated" date. Material changes will be communicated by notice on our website or by email where we have your address. Terms applicable to a completed purchase are those in effect when your order was placed. Continued use after changes constitutes acceptance.
22. General Provisions
Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed. All remaining provisions stay in full force. This applies with particular emphasis to Sections 5, 6, 7, 12, and 13.
No Waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent. We may assign them freely, including in a merger or sale of assets.
Force Majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including natural disaster, war, pandemic, labor disruption, supplier or OEM failure, carrier delay, or government action.
Entire Agreement. These Terms, together with our Privacy Policy and any product warranty documentation, are the entire agreement between you and us, superseding all prior discussions.
Survival. Sections 5, 6, 7, 12, 13, 14, 16, and 20 survive termination.
Headings. Headings and the "Short version" summary are for convenience only and do not affect interpretation.
